Report: Court Date to be Set for Wyckoff Shop Rite Appeal

A judge ruled in August that a supermarket is a permitted use of the old A&P building in Wyckoff, report says.

A trial schedule for the appeal against a court decision that would allow for a Shop Rite to be built on Greenwood Avenue in Wyckoff will likely be set Thursday, according to a NorthJersey.com report.

A superior Court decision issued this August determined that a supermarket is an appropriate use of the old A&P building, Inserra Supermarkets attorney Jim Jaworski told NorthJersey.com. 

The old A&P, which is adjacent to the Boulder Run shopping center, is the proposed site of a new 62,000 square foot Shop Rite. Stop & Shop filed suit against a Planning Board approval of the Shop Rite plan earlier this year.

According to the report, there are still some lingering issues that need to be determined by a judge, like buffering and pedestrian circulation, and Stop & Shop attorneys claim variances for the project were issued improperly.

The township planning board approved the plan for the Shop Rite last November.

Attorneys are expected to receive a trial schedule for the remaining issues in the case Thursday, the report said.
