Wyckoff Dispute Over Approval For New ShopRite Put On Hold By Bergen County Freeholders

A dispute over an approval for a new Shop Rite has caused the Wyckoff Planning Board to reserve decision on an appeal from Stop & Shop for the next month.

The Bergen County Freeholders have reserved a decision on an appeal by Stop & Shop in Wyckoff to dispute the approval of a new Shop Rite to be built by Inserra Supermarkets, Inc. on Greenwood Avenue near Wyckoff Avenue.

The dispute over the project is already in litigation in the Bergen County Superior Court, with Stop & Shop seeking to overturn the Wyckoff Planning Board's approval for the 7.4 acrea property. Gail Price, the lawyer for Stop & Shop says that her client's rights were violated when they were "unable to call witnesses or participate in the planning board hearings". Price also argues that the Planing Board failed to address traffic issues that will occur at the intersection. John Lamb, the lawyer for Inserra Supermarkets, contends that his client has already agrred to pay for the cost of any intersection improvements or traffic light changes that may incur from the new Shop Rite.

Freeholder Chairman David Ganz said that in the twelve years he has been a member of the board, a planning board appeal "has never occured", and that the freeholders will have a decision with the next 30 days.
